1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of nancymcmillan.net (the “Site”), operated by Nancy McMillan, an individual licensed real estate agent affiliated with Leading Edge Real Estate Group (“Brokerage”). By using the Site, contacting us through the Site, or submitting any form on the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. About the Service

nancymcmillan.net is an informational website for the real estate services of Nancy McMillan, Realtor. The Site provides:

  • Information about Nancy’s real estate services for buyers, sellers, and investors
  • Local market content and area guides for Pulaski, Fayetteville, Giles County, Lincoln County, and surrounding South Central Tennessee communities
  • A contact form for prospective buyers, sellers, and investors to request a consultation
  • Links to external services (Multiple Listing Service property search, mortgage calculators, partner lender resources)

The Site is for general information and lead intake only. It is not an offer to sell, list, lease, or purchase real estate. Any actual real estate transaction is governed by separate, signed written agreements between you, Nancy McMillan as your agent, the Brokerage, and any cooperating party.

3. Real Estate License & Brokerage Disclosure

Nancy McMillan is a real estate agent licensed by the State of Tennessee.

Nancy is not a broker, attorney, accountant, lender, appraiser, inspector, or financial advisor. Nothing on the Site constitutes legal, tax, financial, mortgage, or appraisal advice.

4. No Agency Relationship Created by Site Use

Using this Site, viewing listings, or submitting an inquiry does not create an agency relationship between you and Nancy McMillan or the Brokerage. An agency relationship — buyer agency, seller agency, or otherwise — is created only by a separate written representation agreement signed by both you and Nancy.

Until such a written agreement exists, Nancy is not your agent and owes you no fiduciary duty. The Tennessee Real Estate Commission “Working with a Real Estate Professional” disclosure will be provided to you at the appropriate time as required by Tennessee law.

5. Listing Information Disclaimer

Property listings, prices, photographs, square footage, lot size, school zones, tax records, and other property details displayed on or linked from the Site are believed to be accurate but are not guaranteed. Listings are sourced from the local Multiple Listing Service (“MLS”), county records, and seller-supplied information. All such information must be independently verified by the buyer and the buyer’s agents, inspectors, and attorneys before any offer or purchase decision.

Listing status (active, pending, sold, withdrawn) can change without notice, and there may be a delay between a status change and its appearance on the Site.

6. Fair Housing

Nancy McMillan and Leading Edge Real Estate Group fully support the federal Fair Housing Act, the Tennessee Fair Housing Act, and all applicable equal opportunity housing laws. Nancy does not discriminate, advertise, or steer on the basis of race, color, religion, sex, handicap, familial status, national origin, sexual orientation, gender identity, or any other class protected by federal, state, or local law.

7. Contact Form & Communications

By submitting the Contact form or any inquiry form on the Site, you consent to be contacted by Nancy McMillan or her authorized team by phone, email, or — only if you check the SMS opt-in checkbox — by text message, in connection with the inquiry you submitted.

Phone, email, and SMS communications are governed by the Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The content of nancymcmillan.net — including the layout, copy, photography, video, branding, logos, and area guides — is owned by Nancy McMillan or used under license. You may view and print a single copy for personal, non-commercial use. You may not republish, redistribute, scrape, or use the content for any commercial purpose without written permission. MLS-sourced listing data displayed on the Site is the property of the originating MLS and its participants and is governed by additional MLS terms.

9. Third-Party Links

The Site contains links to third-party websites — for example, mortgage calculators, lender pages, the Tennessee Real Estate Commission, or partner inspection services. We do not control those sites and are not responsible for their content, availability, accuracy, or privacy practices. Use them at your own risk.

10. No Warranties

The Site is provided “as is” and “as available.” Nancy McMillan and Leading Edge Real Estate Group make no warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by Tennessee law, in no event will Nancy McMillan, Leading Edge Real Estate Group, or any of their affiliates, agents, or vendors be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Site or any reliance on Site content.

For any direct damages, the total aggregate liability of Nancy McMillan and the Brokerage is limited to one hundred dollars ($100.00).

This limitation does not apply to any actual real estate transaction governed by a separate signed agreement, which has its own remedies and obligations under Tennessee law.

12. Indemnification

You agree to indemnify and hold harmless Nancy McMillan, Leading Edge Real Estate Group, and their respective agents from any claim, liability, or expense (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Lincoln County, Tennessee, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated Effective Date. Your continued use of the Site after a change constitutes acceptance of the updated Terms.
